Last Updated: November 5, 2026
These Terms of Service ("Terms") govern your use of vyolaink.co (the "Site") and the services provided by Vyola Ink Creative Studio ("Vyola Ink," "we," "us," or "our"). Please read them carefully.
Agreement to Terms
By accessing the Site or purchasing our services, you agree to these Terms and our Privacy Policy. If you are using our services on behalf of a business, you confirm that you are authorized to accept these Terms for that business. If you do not agree, please do not use the Site or services.
If you sign a separate proposal, service agreement, or statement of work with us, that document controls if it conflicts with these Terms.
Our Services
Vyola Ink provides services that may include:
- Custom website design and development (including our Smart Websites, WordPress, Shopify, Webflow, and custom-coded builds)
- AI chat and phone assistants (AI receptionist)
- CRM setup, lead capture, and marketing automation, including missed-call text-back, email and SMS follow-up, appointment reminders, and review requests
- Local SEO and search optimization
- Website hosting, maintenance, and ongoing support
- White-label and partner services for agencies
The specific services, deliverables, and timelines for your project are described in your proposal or plan.
Plans, Pricing, and Payment
Pricing
- Services are offered through tiered monthly plans (Solo, Team, Professional, and Enterprise)
- Plans start at $297/month plus a one-time setup fee, starting at $997
- Exact pricing is provided in your proposal based on your needs
- All prices are in U.S. dollars and exclude applicable taxes
Usage-Based Fees
Some features rely on third-party usage, such as phone numbers, call minutes, SMS/MMS messages, email sends, carrier registration fees (for example, A2P 10DLC), and AI usage. Your plan may include a usage allowance. Usage above that allowance, or usage not included in your plan, may be billed separately at the rates described in your proposal.
Payment Terms
- Setup fees are due before work begins
- Monthly fees are billed in advance on the 1st of each month
- Payment is by credit card or ACH, and you authorize us to charge your payment method on file for recurring fees
- Late or failed payments may result in suspension of services until your account is current
Commitment Period and Cancellation
- Solo and Team plans have a 6-month minimum commitment
- Professional and Enterprise plans have a 12-month minimum commitment
- After the minimum commitment, services continue month-to-month
- You may cancel after the minimum commitment with 30 days’ written notice to hello@vyolaink.co
- If you cancel before the end of your minimum commitment, the remaining monthly fees for that commitment period become due
Refunds and Our Satisfaction Guarantee
Setup Fees
- If you cancel before we begin work, your setup fee is fully refunded
- Satisfaction guarantee: we include unlimited revisions during the build phase, within the agreed project scope. If you are not satisfied with your website before launch, and you have given us the opportunity to make revisions, we will refund your setup fee
- Once your website launches, setup fees are non-refundable
Monthly Fees
- Monthly fees are non-refundable
- We do not provide refunds or credits for partial months
Your Responsibilities
You agree to:
- Provide accurate business information and the content, logins, and access we need (such as domain, hosting, and social accounts)
- Respond to requests for feedback and approvals in a timely manner (delays on your side may extend timelines)
- Review and approve all website content, AI assistant scripts, and automated messages before they go live
- Use our services lawfully and not interfere with or disrupt them
- Keep your login credentials confidential
Messaging and Calling Compliance
When we set up texting, calling, email, or automation for your business, you are responsible for making sure your communications comply with applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, Florida’s telemarketing laws, and carrier requirements. In particular, you agree to:
- Have proper consent before we send texts, calls, or marketing emails to your contacts, including contacts you import
- Honor opt-out requests (such as STOP replies) promptly
- Provide accurate business information for carrier registration (A2P 10DLC)
- Not use our services to send spam or unlawful content
We may pause messaging campaigns that we believe violate these requirements.
AI Features
Our AI assistants and automation tools generate responses automatically. While we configure and test them carefully, AI output may sometimes be inaccurate, incomplete, or unexpected. You are responsible for reviewing the information and instructions your AI assistant uses and for how it is used in your business.
AI assistants are not a substitute for professional judgment. They should not be used to give medical, legal, or financial advice, to diagnose, or to handle emergencies. For healthcare clients, we configure assistants to direct callers with urgent or emergency needs to call 911 or contact a provider directly.
Health Information (HIPAA)
If you are a healthcare provider or other HIPAA-covered entity and our services will create, receive, or store protected health information (PHI), you must tell us before setup, and we must sign a Business Associate Agreement (BAA) before any PHI enters our systems. Unless a BAA is in place, you agree not to send PHI through our services.
Our SMS Program
We send two types of text messages. You choose each one separately on our contact form: transactional messages about your inquiry, consultations, appointments, projects, and support requests, and marketing messages about our services and offers. Both consent boxes are optional, and consent is not a condition of purchasing any service.
If you call our business number, (954) 883-9055, and we miss your call, we may send a text reply from that number so you can continue the conversation.
You must be at least 18 years old to receive text messages from us.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.
Intellectual Property
Your Content
You own the text, images, logos, and other materials you provide to us, and you give us permission to use them to provide your services. You confirm that you have the rights to everything you provide.
Your Website
- Once you have paid in full, you own your website’s custom design and content created for you
- Your domain name belongs to you and should be registered in your name
- We keep ownership of our proprietary code, templates, automations, AI prompts, and systems, and grant you a license to use them while you are a client
Platform-Hosted Websites and Systems
Some websites, CRMs, automations, and AI assistants are built on third-party platforms that we manage, such as HighLevel. These cannot always be exported as standalone files. If you cancel, we will provide an export of your content, images, and contact data in a standard format, and help you point your domain elsewhere. Rebuilding a platform-hosted website on another platform is not included but can be quoted separately.
Third-Party Assets
Some assets, such as stock photos, icons, fonts, and plugins, are licensed from third parties. Where licenses allow, they transfer to you; otherwise, they may need to be replaced or licensed by you if you leave our services.
Our Brand and Portfolio
You may not use our name, logo, or branding without permission. Unless you ask us not to in writing, we may display your completed website in our portfolio.
Confidentiality
Each of us will keep the other’s non-public business information confidential and use it only to perform or receive the services, except where disclosure is required by law.
Third-Party Services
Our services depend on third-party providers, such as hosting companies, HighLevel, phone and SMS carriers, AI providers, and payment processors. Their terms may also apply. We are not responsible for changes, outages, or policy decisions made by these providers, although we will work to minimize any impact on you.
Service Availability
We aim for 99.9% uptime but cannot guarantee uninterrupted service. We are not liable for interruptions caused by:
- Hosting or platform provider issues
- Third-party service or carrier outages
- Scheduled maintenance
- Events beyond our reasonable control, such as natural disasters, power or internet failures, cyberattacks, or government action
Disclaimer
We work hard to help your business grow, but results such as leads, rankings, reviews, bookings, and revenue depend on many factors outside our control. Except as expressly stated in these Terms, our services are provided "as is" without warranties of any kind, and we do not guarantee specific results.
Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim
- We are not liable for indirect, incidental, special, or consequential damages
- We are not liable for lost profits, lost data, or business interruption
Changes to Services and Pricing
We may modify or discontinue services with 30 days’ notice. We may update pricing for new clients at any time; pricing for existing clients is honored for your current commitment period. If a third-party provider raises usage costs, we may adjust usage-based fees with 30 days’ notice.
Termination
We may suspend or terminate your services if you violate these Terms, payments are not received, you use the services unlawfully, or, at our discretion, with 30 days’ notice.
Upon termination:
- You must pay all outstanding fees
- If your account is paid in full, we will provide your content and data export within 30 days
- We may delete your data 30 days after termination, unless the law requires us to keep it
Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the services, the content and contact lists you provide, your messaging and marketing practices, your violation of these Terms, or your violation of anyone else’s rights.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Broward County, Florida.
General
- If any part of these Terms is found unenforceable, the rest remains in effect
- Our failure to enforce a provision is not a waiver of it
- You may not transfer your account without our written consent
- These Terms, together with your proposal or service agreement and our Privacy Policy, are the entire agreement between us regarding the services
Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and notify clients of material changes by email or notice on the Site. Continued use of the services after changes take effect means you accept them.
